Hi All,
my letting agent has asked the 3 tenants to all sign new 6 month contracts because the landlord wants to remortgage and this is the condition from the bank.
However, the letting agent has told us in writing they will not hold any of us to the new contracts.
I'm worried that this could be seen as a conspiracy to defraud as clearly the contracts offered as part of the loan will be false if we've been told they won't hold us to them.

The way you describe the situation smacks of fraud to me.

The landlord and agent can decide not to enforce the terms, thats ok, and unless any of you have given them indication to leave, the part about the new contracts makes some sence just in respect it makes all the paperwork flow easyer, but, if those go ahead, check terms carfully.

Some re-finance cos, can insist on certance terms being in the tenancy, and thats why agents sometimes ask tenants to sign new contracts, but you cant keep a tenants to any extra terms on top the contracts there on in respect of there tenancy, the terms added are usualy to just add the finace co to the people allowed to take action or be informed of any action ( were it normaly says landlord or agent in the TC )

It could sound improper possibly ( what there doing ), but there are a number of curcumstances were all the things you are explaining can be legit and just all involved makeing paprwork fit easyer.

If they have made the agreements with the intention solely to obtain a mortgage then that may well be fraud - if they made the agreement in good faith and then later, for some reason, chose not to enforce it then it likely wouldn't be.

Dont want to sign a new contract and would rather leave in case there is something unlawful about it

Its not fraud if you plan on staying anyway. It sounds like the landlord is trying to raise some funds from his rental property. You would have to renew the tenancy at some stage if you want to stay. Its also not fraud if there is a get out clause or a separate agreement, if you are concerned ask for the get out of contract clause in writing

Tenants don't have to renew a tenancy agreement if they want to stay.

Once the initial fixed term period ends they can stay on a rolling contract known as a Periodic Tenancy.

Thanks fir the replies, I have contacted the police and am awaiting their advice.
