  • Forcing property sale by joint owner?

    The co-owner of the property in which my son and I reside is threatening to force a sale, based on their desire to not pay toward the costs of the joint mortgage contract. They do not reside at the address and the mortgage is interest only. This has been 'thrown into the pot' because they owe money to us and they think it can be set against any divisions in the sale, however, there is no equity and it will only result in our being homeless. It is a malicious and vindictive proposal and I am very concerned about such an action. The co-owner has not contributed to the mortgage contract for many years until recently so there is a large shortfall either way. Is this a hollow threat as I dont think a DJ would make us homeless when there is nothing else to gain - am I correct?

      Do you own the property as Joint Tenants or as Tenants in Common? What options you may have available will depend on your answer to that question.

      You say you have a joint mortgage which means that you are both jointly and severally liable for the loan so it doesn't matter (legally not morally ) which one of you pays it.

      What has caused this issue after what appears to have been years without any financial friction?

      Is the co-owner a friend, relative or business 'stranger'?

      How old is your son?
