  • PCOL heard 2 days ago for tenants rent arrears

    If anyone can help please.
    I applied on line about my tenants rent arrears and a court date was given as the 1st November

    I keep checking back to claim history and nothing is showing, what do I do next regards eviction of the tenant ??

    The tenants housing officer has contacted me to hold off repossession and asking the full extent of the arrears and so far I have resisted until I here from the HO, but have said that I will give them until the end of the week to respond.

    What or where do I go from here >

    I really do not want to sell the property and I have offered the tenant numerous payment plans to no avail , but I can't afford to keep the property without the rent coming in.

    The property is not on mortgage but I rely on the income. The tenant has been there a long time and sad it has come to this but I'm not a charity either.

    Could anyone help please

      Was a Possession Order granted at the hearing on 1st November and did you go to court? Or was it a Suspended Possession Order on condition the tenant paid full rent plus something towards the arrears from then on?

      I agree you are not a charity !

      Is your tenant in receipt of Housing Benefit because that can be paid direct to your bank account by the Loacal Authority after eight weeks' arrears have occurred?

      Your next step would be to apply for a Warrant of Eviction but be prepared for your tenant's Housing Officer to advise them to apply for a suspension of that if they have a legal argument.

      How much are the arreas rears and how long have they been accumulating?

        Hi Diana, I don't know the outcome as the PCOL have not updated anything on my claim history as yet (not sure how long this will take )
        Rent arrears are 1846.00.
        Tenant has had housing benefit so only had to pay the shortfall and this has accumulated over 10 months

        A section 8 was sent as well.

        Not sure what legal argument they would have as I have been very patient and would just like the arrears paid and normal payments resumed. I know the tenant has fallen on bad times which is why I have been lenient

          If the paperwork wqas in order you should have got it with the section 8 claim

          Its mandatory as long as all the paperwork is in order usually, if there a mistake or ommision in the paperwork it will get sent back to you
          crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even
