Landlord and eviction

Evening,

My situation explained first....I live in a 3 bedroom house, shared accommodation with 2 other house mates. My contract is a month to month contract and l have been in the property for just under 3 years now. I'm up to date with rent!

I have recently lost my job and lm my rent is due next week, I know l will not have this money and have informed land lord. I have started a new job today but the company is a monthly pay company so will have no wages until end of October. I have explained to my landlord that l will pay in full at end of October for both months and he has refused and said if l don't pay next week when it is due he will enforce section 21 and l will be given notice to leave.

Can l ask how long he has to give me this notice and how long will l have to vacate my room by please. Any help will be appreciated. I did go to the council and benefits for help but because lm back in work and was only out of work for a short time no help is offered too me

Hi, to be sure i would need to see your tenancy agreement so i can understand what you mean by month to month

Does the Landlord live on the premises
Are the contracts separate ( you each on your own contract )
Has the LL renewed your tenancy every six months/year or has the original just carried on

Morning,

The landlord does not live there, we all have seperate contracts and it was renewed roughly 4 months ago when it changed from a fixed term to a rolling month to month contract

hi, was the fix term 6 months, and did he already serve a section 12 at the end of the last one, if not your on a periodic tenancy

if so, then he would have to give you notice then apply to court ( Your on an AST ( contract ) in a HMO ).

First of all congratulations on the new job

As Crazy Council has said if you're a statutory periodic tenant on a rolling contract following a fixed term then your Landlord can serve a Section 21 Notice to seek possession whether you have rent arrears or not. The law says a Landlord can take back their property without giving any reason.

If you pay your rent weekly (if that's what the tenancy agreement says) then he has to give you 8 weeks' notice. But does he really want to get shot of you, or was this just a threat to put pressure on you to come up with the money?

I've no idea of the nature of your work but employers can sometimes agree to give you an advance on your salary if they are aware of the problem caused by having to wait. After all you will have worked some of September so it's not unreasonable to ask for that amount to be paid at the end of the month (September) and not wait until the end of October for that sum. If there's an HR department at work go and talk to them. If you don't ask you don't get.

Fingers crossed that common sense will prevail with your Landlord who probably doesn't want the faff of sourcing a new tenant.
