    When is a loan not a loan?

    If I am arguing that a private loan on a property is not a real loan, what legal precedents/tests are there for this? Where would I begin to look for this?

    If the loan is documented its a loan problem may be with its terms conditions and if any interest rates

      It is documented by a hand-written agreement between parent and son. Terms are to pay back "when in a better position to do so"
