S21 notice & legal support

Hello - just briefly - is there any legal support (aid/help) available for (qualifying) tenants prior to a LL applying to court for eviction?
Also if the S21 notice is likely to be invalid due to the LL's failure to serve the prescribed information (deposit protection / AST) on time - how can legal costs for a counterclaim (penalty up to 3 times the deposit for failure to serve the prescribed information) be covered - through BTE / ATE insurances? If so, does anybody have any recommendations regarding good BTE / ATE insurances? What are likely maximum costs in case the LL succeeded with eviction proceedings in the first instance?

Shelter has some useful information on eviction - http://england.shelter.org.uk/get_ad...n_for_eviction - and will also be willing to offer lots of help and information prior to any court action. [MENTION=15129]Crazy council[/MENTION] might be able to offer some useful advice too

Hi

Generally, you can only claim of the LL in such curcs if he illegally evicts you ( damages ) . There is a lot of automatic help available if your being evicted.

Section 21s can be argued, under some circumstances, and if the LL has not protected the deposit properly, they may not be able to use section 21. But there are many other options available to the LL It depends on the other circumstances

1. Why are they serving a notice ?
2 How long have you been there ?
3 any arrears
4 Any work needed doing to the prop ?

Thanks for all the responses so far -
@Kati - I had contacted shelter prior to posting, however I'm currently unclear from the information received from them, if they have a legal in-house team that would be able to provide legal support.
@Crazy council -

I have corrected my op - I meant compensation (penalty of 1-3 times deposit for failure to serve prescribed info)

1. They state they want to sell, however they have said this a couple of times over the last 5.5yrs (including previous s21 notices) and continued after negotiating...

4. mould issues recurring - I have notified them a few times and a number of clothing items are damaged due to mould (also previously it took them about a year to sort out a window that wasn't opening; hot tab; gas cert)

Thats interesting, do you have the original tenancy agreement, i will read up on the current regs and post back on this later..

as much details on that as possible, when you say the AST was not on time, what do you meen.

Illegal eviction and harassment by a landlord is not that hard to claim, trying to subvert normal court process to attempt to evict a tenant can be classed as both. there is something else am not sure of and i will have to check up on the regs to see if they have changed.

is your LL selling because he needs to ?
