                  Ive found the T & C very hard to read, however Ive gone through them twice and I cant seem to find any clause entitling the lender to appoint LPA Solicitors.
                  Its quite possible that Im missing something, so if you can read through your hard copy of the T & C to see if you can find any reference to LPA Receivers, formal demand or enforcement procedure

                    LPA receivers only have limited statutory powers, but the lender often extends their powers through the terms of the contract

                      Only terms i can see is where they can pass the debt on to debt collection agencies acting as agents under terms 11 and the lender may assign rights and transfer his obligations under the agreement at any time under term 14.

                        Thanks Teaboy thats all that I noticed as well.
                        I honestly dont know if these terms can be broadly construed as entitling the lender to appoint receivers. Usually there are express terms within a contract re appointment of LPA Receivers, and also the fact that LPA receivers are deemed the borrowers, not the lenders agents.
                        Does anyone have any thoughts on this please

                            I can't see any mention of LPA in the T&C's. .... do you think I can get the LPA to resign ?

                              The best advice I can give is that you arrange a free half hour appointment with a solicitor, take your paperwork along and raise the points Ive queried
