  • Signed for parcel delivery

    Recently I took in and signed for an enormously long parcel addressed to my neighbour. It appears that a long
    thin metal pole was missing from the parcel as it had a small hole in it. Both the supplier and courier deny any responsibility and say it was signed for by me. Am I liable? So much for doing my neighbour a favour!

    My opinion is that as you had no information as to the contents of the parcel you could not be aware that the
    parcel contents were incomplete.

    Deny liability as you signed only for the parcel delivered not the contents which were no checked.

      From your neighbour's point of view if the parcel has arrived incomplete it is the vendor's responsibility and they should send a replacement/refund.
      If it was not left with you by prior arrangement, the courier failed to deliver to the right person.
      How many couriers, who work to a very tight schedule, would hang around whilst the consignee unpacks and tries assembling eg a flatback to ensure it is all there!

      From your view point as per Nem. What are the chances of the courier doing anything about it anyway.

        Thanks for answers. The courier company say that I signed for delivery "in good order" and that I am now responsible for any damages. I was hoping for a legal clarification of my position.

            Who are the couriers?

              I did not receive the item and on contacting you I was advised that the delivery driver had left the item [with a neighbour] [add details of location item was left].

              Under the Sale of Goods Act 1979 the goods remain at your risk until they are received by me and I would request that you now make arrangements for the [item] to be delivered to me without delay and would request that you confirm that you will do this by return.

                Update, which seems to put me in the clear. Supplier is liable to ensure delivery reaches customer in good order. Neighbour did not authorise delivery to me. All I signed was an electronic pad thing, I certainly was not shown anything to suggest I was accepting legal responsibility. It was UPS and their contract is with the supplier, nothing to do with me. Neighbour is going after the supplier and failing that his credit card company. Maybe next time I'll just refuse to sign anything and say goods left at couriers risk.
