    I've been living with my partner for nearly 15 years now and at the moment things aren't going so well.

    Every weekend, he seems to cause all the rows and arguments and then accuses its me!!

    When he causes the arguments, he shouts that if I don't like it go and find somewhere else to live.

    Sometimes with his behaviour, he makes me feel he doesn't want me here!!

    I do virtually all the household cleaning, laundry, and the cooking.

    We never go out for meals, or do things as a couple ie like going to the pictures like what we used to.

    I feel that all I am at the moment is just a cook and a cleaner.

    Its so bad he doesn't even offer to make me a cup of tea!!

    I would love to go back to living on my own again but need some advice.

    In 2010, the local council took me to court and slapped a 2 year asbo on me over a neighbour dispute.

    I can show through letters that the council repeatedly refused to help me, and that I have a copy of my neighbours interview under caution when I complained to the police of death threats.

    I tried very hard to defend against the proceedings, but the solicitors I employed were useless to say the least.

    I am disabled and in ill health, I never breached the asbo.

    My question is would I be entitled to social housing?

    I currently receive contributions based ESA support group and DLA.

    Any help please much appreciated.

    Hi [MENTION=29373]Spellkaster[/MENTION] - what you are describing there sounds very much like it could be classed as Domestic Violence (verbal is just as bad IMO - and I've been there ). According to Women's Aid (http://www.womensaid.org.uk/domestic...08000100320002) you could be eligible for emergency housing through your council under the 'homeless provision':
    Emergency accommodation
    You are considered homeless if you are unable to stay in your home because of a risk of violence or abuse. Your local authority (council) housing department has a legal duty to provide you with advice about finding somewhere to live if you are homeless because of domestic violence - and they should also provide temporary accommodation for you. They may also eventually provide permanent accommodation (see below, Obtaining permanent accommodation).

    You can apply for emergency or temporary accommodation while you decide what to do next; leaving home temporarily will not affect your right to return, or your tenancy rights or ownership of the home. You have the same rights to emergency accommodation whether you rent your home from the council, from a private landlord or a housing association, or if you own your own home.

    The council may offer you an appointment to explore your options first. This should be in addition to, and not instead of, an interview to make a homelessness application. You should not be pressured to stay in your own home, or to find alternative private rented accommodation, if you are at all concerned for your safety
    Please ... get an appointment with your local council's housing section ASAP to make a homeless application under this provision. You are worth more than you are getting right now, and you deserve to feel happy, safe and secure in your own home!

        Under the DV measures, they cannot refuse to give you emergency accommodation under the homeless provision.

        How long ago did you get the asbo? I believe they are classed as 'spent' after minimum 2 years unless they were originally unlimited/ordered to be for longer (http://www.cps.gov.uk/news/fact_shee...ial_behaviour/)


        EDIT: re-read your first post ... you got a 2yr asbo in 2010, so it's been over for 2yrs + now! It shouldn't be seen as a stumbling block at all

          I got the asbo in November 2010, and lasted until November 2012.

          No claims of any breach, and I tried unsuccessfully to defend against it.

          I was also put all over the front page of the local newspaper as well which was awful!!

            so ... not a stumbling block

            You need to go to the council and apply for housing under the homeless provision due to DV (mental abuse). If you'd prefer to go to a different county, you can (especially if you have a 'family connection' there)
