    You are correct and our last letter from out solicitor made clear we need proof of their claim to our land.....nothing...no answer
    what do you do then ...if you want to sell you can not make people answer ...can you ???

      ................. so the next time they write the response is a letter from your solicitor telling them to cease or else you will apply for an injunction under the protection from Harassment Act 1997.
      IMO your solicitor should have done this already, but I suppose that if the Letter tennis continues indefinitely he has a constant source of income.

        The issue is therefore the neighbour himself. Obviously, he thinks that he can get what he wants through a campaign of harassment and intimidation, so it is this that needs to be addressed. An extremely stiff letter from your solicitor threatening him with an injunction under the Protection from Harassment Act 1997 might do the trick.

        Now here's the catch - if you do this, then when you come to sell, you may well have to declare the existence of an unpleasant neighbour. This might put buyers off.

        However, this then begs the question - is he aware of your intention to sell? Is he attempting to frustrate your sale in order to force you to sell (or even give), the land to him? If so, then you probably have no choice other than to seek an injunction.
        Again you have the whole picture
        he found out we were about to sell and he started the whole think up again......but every time we send a letter asking for his proof of his claim he goes quiet....for 6 months......Hey hummm there should be a law against this .....but i can't find one????

          Well we were trying to avoid the injunction.... and the cost of one.... this why i am here in the hope some one else has been through this but made a resolve....

            There is - the Protection from Harassment Act 1997.

            Well we were trying to avoid the injunction.... and the cost of one.... this why i am here in the hope some one else has been through this but made a resolve....
            A straightforward injunction shouldn't be that expensive - cheap really, when offset against peace of mind and being able to sell. Contact a local solicitor who offers free initial advice.

              Yes but not a good selling point when you have to say you have taken out an injunction against a neighbor.....
              I have now sent a copy of the letter and a copy of the plan that was sent to them from the land regisitry to their new solicitor asking to meet with them on the boundary and try and reach a resolve.... I can only hope she will advise them this would be the sensible thing to do.......
