    Hi...I would appreciate any advise please....Long story short....I am recently disabled due to medical negligence,was earning 45K a year growing a company that was doubling its turn over year on year...and now its highly likely that I cannot work ever again due to damage to my spinal cord,clinical neg case started...I have waited 20+ weeks so far for Atos to get in touch about an asessment for ESA and PIP,still nothing.All I recieve is £71 a week.Last week The DWP confirmed they would pay some of the intrest on my morgage but not all of it.The back dated sum of £647 was paid to my mortgage company (nationwide building society NBS) and a weekly payment that will cover most of a new arrangement ,an intrest only mortgage one as I obviously cannot afford to pay the £235 a month I had been paying up until now.
    I have paid this mortgage all the time whilst too ill to work and until the DWP decided my fate...with an overdraft of £1000 ,loaning money from parents and selling my belongings on-line I managed to pay it over than an arrears of £113.
    So now the DWP has paid by back dated payment of £647 to the NBS....So my main mortgage account is in credit by £647...and as my account is switching to an intrest only mortgage...the money will not get used it will just sit there in my account until I (if ever) start to pay the full amount again,which as it looks very unlikely I will be capable for work ever again it means the money will just sit there.My other re-mortgage account with them is in arears by £113.
    I asked them to pay the arrears from the £647 and send me a cheque for the remaining amount,which is so desperatly needed at the momoent as I am just about to become house bound without acsess to public transport, I need the money to tax my car and pay the insurance and diesel to get to the many hospital appointments and scans im still having...They said I cannot have the money as the DWP says its for that 1 mortgage account only and I cannot withdraw this.
    I said that I have paid that account and that money is mine...give me it please...They said no.
    What can I do?
    My only thought now is to ring them and say ..."You owe me money ,I owe you money....Until you pay me what you can afford in order to clear the amount you owe me,I refuse to make any arrangement with you for me to pay you what ever I can afford in order to clear the amount I owe you.The balls in your court"

    What do you legal people think? Is the ball in thier court or will I end up in court?

    As you are Disabled you should if getting the correct Benefit be exempt from car tax are you getting all the benefits you are entitled to.

      I am disabled but as the NHS still after nearly 2 years of knowing my illness i am still yet to see someone in a position to diagnose me ,a Neuroligist, hence a clinical neg case ongoing...My Neurosurgeon who operated was a private hospital one (on the NHS) and he said funding was not there for him to diagnose or investigate my symptoms...I see a Neuroligist who can carry out nerve conduction tests in order for me to get a diagnosis,the appointment for him is next month,tests? diagnosis of condition?...social services,blue badge all need me to have a label, so I have been told...me saying Im disabled and cant move without discomfort and on prescription pain killers means nothing until I have a named disease or spinal condition.

        Sorry to say the System does not act at speed my wife and I expect thousands of others who are Disabled have gone through the same , Hope you get this sorted all the problems you will have till then can be overcome lots of advice from others on here to see you through.
        There is no magic wand that waves to speed up the process.

          Thanks Wales01man...I have now sorted out the problem...Thanks to the Finacial Ombudsman peoples advise I rang them with confidence and amunition....but didnt really use it and said I require a refund and was going to say this or that but it appears its all about who you get on the other end of the phone it would seem, as all I did was ask and this guy thankfully gave this time...Lets just see if that cheque comes.If it does then all is good

            In terms of Nationwide, I would possibly approach them on the basis of financial hardship.....

              Had a call an hour ago from a guy from NBS...He told me they had recieved a letter from the finacial ombudsman and that he was ringing me to see the problem...I told him the matter was now resolved and there is supposedly a cheque in the post for me...He said he would check that and get back to me...Soon after another guy rings me apolagising that I was told the wrong thing the other day and that I cannot have my money...DWP says so and thats that...So I said give me my money not the DWP money then as you have now accepted payment twice...No .All they can do is send me £50 as a way of an apolagy for misleading me to think my money was mine the other day...and send me some form so i can request the DWP make an exception on me, I already have rang the DWP and all i got from some twisted little jobs worth is "maybe we should investigate you if you paid your mortgage yourself when on such a low income" she offered no form or way of help just cheap threats of an evil nature...
              I told the NBS guy that I will not pay them a penny until this matter is resolved, they said i will just get fined and its tuff luck basicly.
              And as for tell them of hardship...thanks but it made no difference, they want to keep my money weather i starve to death am awaiting op`s or owt.
              I told them take me to court because any judge would see this is crazy and I have done my best...I a recovering from a major operation disabled guy makes an arrangement on wednesday where all parties are happy and paid up to date...and now thanks to the finacial ombudsman and nation wide changing there stand, no one gets paid and the disabled suffers some more...I even had spent the cheque already.I am Not happy.

                Have you got a decent GP? Would he/she be prepared to write to ATOS etc to get you seen any sooner ?

                  Thanks for your help Inca but I have the worst GP ever, its one of the reasons why I have the med neg claim going on...I have a new GP but as I am so full of it all with whats gone on she is a bit already taken back by my wants and demands for treatment...I will have to ask for something in order to get a home visit when ever they get around to offering an assesment so I dont want to push my luck.Thanks for advise anyway

                    Did you contact or write to the FOS without going through the bank first?(am trying to clarify something firstly)...

                      I first telephoned nationwide to be told theres nothing i can do the money cannot be paid to me,arrears cannot be cleared and the credit cannot even be used to pay future payments that I now have to make...I then went to the CAB,advise was to ring Civil Legal Advise (think thats what they are called) and was told the only peolpe who can help are the FOS...Rang them and they said they agreed with my reasonable request for payment and would send a letter,Straight away I rang Nationwide again and requested payment informing them that FOS was on my side and would be in touch with them, I did not tell him of my last recent refuseal of payment expecting them to know...Payment was issued, story above its now not..day or 2 later they get FOS letter and they like above contact me and the payment is stopped.Now I am at war with them when peace had been made,any help would be appreciated please.

                        And to add insult to injury on saturday i recieved a new DD plan for the full mortgage amount of £55 instead of the agreed intrest only amount of £21...I told them I am on ESA`s £71 a week ...I am going to cancel the DD.

                        The bank has £647 of my money sitting in an account in credit that is upto date and now getting paid on an inetrest only mortgage by the DWP.
                        My other account (re-mortgage) is in arrears by £113...This account the DWP thinks my £71 ESA can afford to pay and they will not,So I rang up the NBS and arranged an intrest only payment of £21 a month for this account...and the arrears of £113 to be taken from the £647 thats in credit on other account...and as I am suffering extreme hardship I would appreciate any money owed to be sent to me...they agreed,cheque in post.
                        All parties were happy, no accounts were in debt, future payments organised and affordable(well once i do get what im entitled to)...and a disabled hugry cold poor fighting for his health guy given a break with a cheque that would allow him to keep his car and give him some freedom.

                        BUT now...Thanks to NBS or even the FOS for changing things...I now have a debt i cannot pay,there is no arrangment made for future mortgage payments and I have no funds to make future payments.And also I now cannot buy road tax ,insure my vehcle or even afford diesel.

                        Do I have any legal ground here...I tried and sucseded in making all involved paid and happy and they just want to make things worse,it would seem...and at a cost to my health as well as pocket.

                          I take it all back...The Nationwide Building Society does have a heart,or someone there at least does...I have a cheque for the money owed and on top of that £50 compensation for my trouble...It`s a shame I had to fight for it and get upset,threaten the tv watchdog programe and involve the FOS...but just goes to show dont except what your told if you know your being fair and moraly right in your requests...sit back and you get nothing.
                          Thanks the NBS for showing your human and not just a money making machine governed by paperwork,and especially that of the DWP.
