Hi...I would appreciate any advise please....Long story short....I am recently disabled due to medical negligence,was earning 45K a year growing a company that was doubling its turn over year on year...and now its highly likely that I cannot work ever again due to damage to my spinal cord,clinical neg case started...I have waited 20+ weeks so far for Atos to get in touch about an asessment for ESA and PIP,still nothing.All I recieve is £71 a week.Last week The DWP confirmed they would pay some of the intrest on my morgage but not all of it.The back dated sum of £647 was paid to my mortgage company (nationwide building society NBS) and a weekly payment that will cover most of a new arrangement ,an intrest only mortgage one as I obviously cannot afford to pay the £235 a month I had been paying up until now.
I have paid this mortgage all the time whilst too ill to work and until the DWP decided my fate...with an overdraft of £1000 ,loaning money from parents and selling my belongings on-line I managed to pay it over than an arrears of £113.
So now the DWP has paid by back dated payment of £647 to the NBS....So my main mortgage account is in credit by £647...and as my account is switching to an intrest only mortgage...the money will not get used it will just sit there in my account until I (if ever) start to pay the full amount again,which as it looks very unlikely I will be capable for work ever again it means the money will just sit there.My other re-mortgage account with them is in arears by £113.
I asked them to pay the arrears from the £647 and send me a cheque for the remaining amount,which is so desperatly needed at the momoent as I am just about to become house bound without acsess to public transport, I need the money to tax my car and pay the insurance and diesel to get to the many hospital appointments and scans im still having...They said I cannot have the money as the DWP says its for that 1 mortgage account only and I cannot withdraw this.
I said that I have paid that account and that money is mine...give me it please...They said no.
What can I do?
My only thought now is to ring them and say ..."You owe me money ,I owe you money....Until you pay me what you can afford in order to clear the amount you owe me,I refuse to make any arrangement with you for me to pay you what ever I can afford in order to clear the amount I owe you.The balls in your court"
What do you legal people think? Is the ball in thier court or will I end up in court?
