I'm not sure that's strictly true. You're not asking them to change the terms of the mortgage, you're asking them to make a concession by charging interest only for a short period of time (12 months). I don't see why they need a signature from your ex-husband for that. They certainly didn't care whether you were involved in any dealings when they got that Suspended Possession Order, and they probably wouldn't think twice about seeking full possession and evicting you and your children without his full knowledge. I think they were using the signature thing as an excuse to play at silly buggers.

I did say that the 40 missed payments ( there is not 40 missed payments a lot of it is there interest and arrears charges ) they were all before I took over the mortgage since I made the arrangement with them back in April 2012 there has not been one missed payment plus I have paid extra but they are focusing on the account before this time plus that I did not ring them to tell them I was paying septembers payment late which I did not because I did not know it was late but you may as well speak to a machine as I think they all have a script in front of them that they must not deviate from.
As to not losing my temper with them I have bent over backwards for them in the last 19 months let them speak to the police about my marrage problems to there insistence with the threat of eviction if I did not, then I had to send in medical reports about my daughter when she attempted to take her life again at there insistence with again the threat of eviction if I did not now they are distancing themselves from any involvement because it suits them, plus every month I rang them to continue the arrangement eviction or repossession was always mentioned it was a phone call I dreaded, I was in quite a fragile state in the begining so I would have done anything they asked bare in mind I had had 15 years of bring told how stupid I was how I could not ever managed in my own I was not allowed a job, to answer the phone open letters wether they were address to me made no difference we all use to dread the key in the door so when he left it was such a relief that the thought of losing my home was and still is unbearable but now they have done it so I take sarifaction in the fact that she could not answer my questions as the answers even to her must have sounded stupid they have made me feel so unsettled and nervous over the last 19 months to the point where I have not even wanted to do anything around here in case they took it from me,
So if I do win in court which I hope to god I do I will have it in black and white and they can go and get stuffed they will not be getting any more phone calls from me I will pay my payments every month like I have been doing and that is all they will get and I fully intend to put in a formal compliant about the way they have treated me the worm has turned so they say, sorry for the long post I feel better now lol

Mercifully it's not up to GE Money to decide whether you stay or not - it's up to the judge. Shelter have also said that they'd ring them so let's hope they can knock this on the head without the need for you to go to the hearing ray:

When I spoke to GE this morning they said they would not except any proposals that shelter make to them they seem determined to get my house whatever I do and believe me I can not do any more she seemed to be taking pleasure from my situation this morning thinking back on it now when I asked her to explain the reasons behind the decision to evicted me she said I have already explained this to you once I don't need to do so again but I said I would like to hear it again so she had to.
I can understand that yes I do owe them money which they have made a lot worse and I know it's there job to get it back but do they really have to take such pleasure from it they are making myself and four children homeless a month before Christmas and again I know it there job not to be emotional but honestly where do they get these people from they are like robots.
What makes me more determined to complain about them is the fact the way she spoke to me reminded me of the way my ex use to speak to me and the way she dimissed me they are evicting me they should at least spend a few minutes talking to me about it I am so mad with them

What level of person have you been talking to? Is it a manager in the collections team at G E Money or a litigation clerk at Simply Law their in-house legal team?

Try not to worry any more tonight. You've already got rid of four previous Eviction Warrants so I see no reason why you shouldn't succeed with a fifth. And this time you've got Shelter backing you all the way

All calls should be recorded so that G E Money woman will get her comeuppance when the FOS ask for the tape and/or transcript of her call once the OP makes her complaint of harassment

She was an account manager I have never asked them for sympathy and don't want it I have come this far it just seems when everything is going ok something else happens I can't even tell the kids where we will be spending Christmas if it was my overspending then ok but to just get this dumped on you at the time I thought its a small price to pay for peace I still do I am happy to pay it back what I'm not happy about is the amount of charges and interest they have put on it,
I went to the council in August 2011 with the eviction notice we had just split then and I got this that's when the mortgage rescue was mentioned this went on till the February of 2012 so that's 7 months but in that time the government paid I think £2000 all together then I had the last eviction in April 2012 when I rang them told them about my job and could meet the monthly payments which I have since.
When I spoke to the court to find out dates and how many warrents she told me that in 2007 when the possession order was issued the arrears were 2145 so gods only knows what has happened as in August 2011 they stood at 28000 but then charges and interest are I expect half I am going to ask for all the charges back and they can take it off the arrears.

Yes your right there it made him feel good about himself to control with threats (and sometimes quite often towards the end) of violence you never knew when he was going to do anything but it was always our fault never his but looking at all the missed payments bills not paid he was pretty useless himself,
at least I am trying to get things paid trying to keep a roof over our heads.
