  • Help Please with Blemain Eviction

    Hi
Firstly thanks to anyone who can help with this problem. I have struggled for as long as I can without help but now don't know where to turn. Some years ago I had the misfortune to take out a secured loan with Blemain via Ocean finance. I am a contractor and had dropped out of work and ran into problems with our primary lender. Out fo desparation I went to Ocean to secure a loan to stop eviction. On reflection I should have done anything but use these people. We have had constant issues and I cannot ever see me paying it off. Apologies for the waffle but we are now in real trouble with Blemain. A couple of years ago they secured a possession order against us. I cleared the arrears but did not know I could go and clear the order. Just after Christmas we suffered a family bereavement which left a relative with no means of support and no means to pay for a funeral. I subsequently helped out financially but this has now caused teh current problem with Blemain. They applied to the court on Friday for a warrant of possession. I had no previous warning at all that they were about to take this action. I spoke to them this morning to try and sort the problem out. They state that I have £900 arrears, I have quieried this as I believe teh figure to be incorrect. I have submitted them a statement of earnings with a proposal that I pay £200 per month over my current repayments. Having experienced theor methods previously I have real doubts that they will accept my offer. The person I spoke to said that there is nothing we can do to stop an eviction date being issued and our only hope is an arrangement with them. Is this correct, is there anything I can do right now please. Any help at all appreciated. My wife is in bits and I am at my wits end. As far as I knwo thw primary lender has not been informed of the intended action.

Belmain shouldn't be using the original suspended possession order to obtain this Eviction Warrant. Perhaps the court wasn't made aware that you had paid off the original arrears referred to in that order, and Blemain should have to seek a new order. Contact the Shelter Free Advice Helpline 0808 800 444 and they should be able to help you to find a lawyer to stop this:
