    hi

    i need some advice. i am soon due to leave my rented accomodation, i purchased a new hoover in order to ensure the place was cleaned thoroughly however it has torn some holes in my carpet because the belt was dodgy (which has been confirmed by the store) but they want me to get three quotations for the damage before they will look at compo and i just simply dont have time to do this whilst working 42.5 hours a week. as i am due to leave would my landlady take this damage out of the deposit i paid when i first got the flat or would she be able to charge me more for the damage? im just worried as i know the deposit now the landlords fill in a form to say how much they are happy to give you back dependant on the condition of the flat, i just dont want to get stung with something that wasnt my fault.

    Your Landlady can only deduct the cost of the damage from your deposit if she can prove it. Was there an inventory taken when you moved in since that is the only way she'll be able to provide any evidence of the 'before' and 'after' ? Without that she hasn't got a hope in hell

    How much she can deduct depends on a number of things. For example she wouldn't be able to charge for the whole cost of a brand new replacement carpet if it wasn't brand new when you moved in. The TDS arbitration scheme generally works on a sliding scale of 10 years. So if the carpet was 5 years old when you moved in and you stayed for 5 years she would only be able to recover 50% of the replacement cost because wear and tear would be taken into consideration.

    It doesn't matter whether you or the Hoover caused the damage you would still be responsible since you have signed the tenancy agreement. Otherwise you could throw a party and when the place got trashed you could say "it wasn't me it was my uninvited guests".

    Having said that the retailer who sold you the Hoover has conceded that it was the faulty Hoover which effectively caused the damage and has offered to pay you compensation. Get that in writing. Common sense says that your actual loss will be whatever sum is deducted from the deposit by your Landlady. The retailer has asked you to get three estimates and you'd be wise to get at least two. Most estimators will come round on a Saturday if you work during the week.

    I agree it wasn't your fault but nevertheless it is your problem

          i actually cried! i had it on a low setting and it felt really heavy when i moved it and i thought, maybe im just being weak. pushed it across the carpet and because it was heavy it stopped. i turned it off after literally 2 seconds and i lifted the hoover, there was the damage....torn carpet! nightmare!

              well it was my sensible thinking, new hoover not sure how powerful its going to be and im glad i did. i couldnt imagine what it would've done on high lol oh well we live and learn

                      Rented accomodation, is it legal?

                      I live in a private rented flat, been here for 4 months now and have been asking my landlord for smoke alarms, none where in the flat when i came in and he is just ignoring me....
                      I thought it was the law now that rented accommodation must have smoke alarms, is this correct????
