  • Housing Association rules

    I have been asked as a tent rep to help with a problem by a tenant of a housing assoc.
    Situation:
    The tenant joined this HA when it was under a different name. In the then hand book it stated that " No caravans,Boats, trailers or any other vehicle" could be parked on HA property.
    The property concerned has car parking for two cars designated for that property on and in the boundary of that property. So they were basically saying you can`t even park a car on a designated car park designed with that in mind.
    This tenant wants to go touring so has asked for a small tourer caravan be allowed, but has been refused citing the above.
    The new handbook for the new HA has nothing about caravans, nor can I find any policy documents on the publications part of the website.
    We have a new tenancy agreement every time we agree to a rent increase although we do not get a document as such.
    My query is : Do we have any recourse under human rights etc?

    I can understand that sometimes they can be an eyesore but I believe evry case should be on its own merits.

    No.

    If you still want to try your luck, go through their documents with a fine toothcomb, highlighting absurdities such as the 'no vehicles even though there are parking spaces' rule that you mention above.

    Don't hold your breath though - restrictions on caravans and the like are understandably common.

      I agree. The problem is that as soon as they introduce discretion, then someone parks a caravan and moves 20 people into it, or parks up a mobile van then strips it for parts and leaves it to rust. How do they know your tenant won't do this?

      It's a longer term answer, but the key to this is new rules. You are right. Times change. But times don't always change people. The HA needs protections because they are YOUR protections - against the stripped down rotting mobile home next to you.

        My HA has the same restrictions and I'm glad they do because the minute the rules are relaxed for one person,everyone will want the same,and no,I don't fancy an old shed parked next door to me.

          If you enter into a new tenancy agreement every time you agree to a rent increase (as you state) there must be a new contract to sign. Have you checked this with the HA and could the new tenancy agreement have new terms vis a vis parking arrangements/limitations? I would also check whether the restriction applies to short-term (overnight) or long-term parking or any other vague definitions in law which would give your friend legal wriggle room.
