  • How long (statutory time) to vacate property before repossession

    Hi everyone

    Does anyone know if there is a minimum amount of time legally you have to be given before you leave the property.

    We had the eviction date on July 26 2010, but prior to that, received the eviction letter on the 20 July, dated the 19 July).

    If there is an actual time limit, would that mean we would have a case against them, (that's not including the fees,shortfall we have against them already).

    Not sure what you could do now but at the time you could have made an application to the court to suspend the eviction on the grounds that 7 day notice is not enough time to make suitable relocation arrangements, our mortgage company, in 2001, gave us 2 days notice of eviction and the judge was furious and suspended it immediately and made them re-apply from the beginning, took them months to repeat the repo process, and still failed to have us evicted!

      Thank you for this information. We are currently going through proceedings which will probably end up in court. This will be a part of the ammunition to use against them.
