      Thanks from the bottom of our hearts to everyone for all their efforts and good wishes. Particularly those who seem to have nothing else to do but help us! It's restored our faith in human nature. Sadly it looks like we've been beaten. Complete travesty of Justice. Going to now have to concentrate on packing over the weekend ready for the eviction on Monday. Still have to find a bit more money from somewhere for deposit etc for the house we're going for. Thankfully I know the agent well so he's happy for us to go in without credit checks and we can cover the rent once we're in.

      I guess we'll be online till Monday first thing but then not until we've got broadband in the new house. We will be back and hopefully helping others.

      New house, new start I guess.

        Oh Jumbo, I'm so sorry to hear your news, I know you're devastated and feel like a complete failure, honestly hun you're not, you're just a victim of bad karma.
        Sooooooooo, now as you say its time to get ready for the move and start to look forward, a fresh start and a new life, you never know this could be the beginning of better things to come.
        Personal question time, tell me to bog off if you want, but have you any other debts ?

          I hope all works out ok for you, I am sure before long this will all be like a bad dream.
          There are worse things can happen we all know that but when it's you it's happening to it never feels like that at the time

            Hi Jumbo

            I am very sorry to hear that they would not grant you an extension of time.

            As we are unaware at this time which mortgage company you are/were with there may well be some excessive charges to claim back plus not sure if you have checked if there was also any PPI payments which have been added to your mortgage either which you were aware of or not. You can PM me hun if you wish as if the mortgage lender is a sub prime lender there may well be more to this than meets the eye.

            Whoever the mortgage company are they will more than likely come after you for the shortfall if they can and they will add all their costs as well and probably sell the home for under it's value. If your friend is an estate agent perhaps he could value the house now so you can see if it is fair play after they sell it for a value below par.

            We can always help better when we have all the facts.

                Desperately sorry to hear you've been unable to stop the eviction.

                  I'm afraid there will be quite a shortfall. In fact I don't think the bank will net anything because of the building society mortgage on the property. The bank's is a second charge. I have protested that they are not taking a commercial view of the repossession. Mortgage £90k Valuation at auction in writing from a local agent £100 - £110K Their valuation(£150k) and the realistic one are a long way apart. It is basically a building plot with a little run down worthless property on it. I bought it originally to build a nice new house on for my family. Obviously prior to the 'alleged fraud'.

                  Big stick approach by the bank as usual and I think the stress is far from over even post eviction.....

                    I want to say thanks for sharing your problems with us because I spend a lot of time and effort battling subprime, banks and the destructive effect they are having on our economy. There is a modern trend of financial institutions who, because lack of law representation on the part of the public and the highly emotive issue of losing your home, are riding roughshod over the rules or using them to their own advantage only.

                    I can't imagine what you are going through, this is your home not just a house and all I can say is I really wish you luck. Please stay on the site when you are settled and when things are better you can put this matter under the microscope, list all the salient points of contention and pursue them doggedly. I do need to read back over the thread to see if you requested all your details.

                          DO NOT FORGET
                          you have not lost the battle yet necessarily. You still have the fraud side you could pursue. For it to be reasonable to do this, it is not feasible to pursue the individual, but if the relevant bank has a sufficient involvement to be proven as acting fraudulently, they would be obliged, should you win a case, to put you back in the position you were previously, plus compensation.

                          All is not lost.

                            Sadly, it would have to be the individual I would have to pursue. Effectively I lent the money to my former friend. The bank are not liable in that respect. He does have substantial pension funds.

                                Hi Everyone, We're back online in a lovely house. We all love it. Far better than where we were. Pretty traumatic process but we're getting through it so take heart anyone having similar problems. Hope to 'regroup' shortly and go at the bank etc.
