    I would suggest you make the an application to suspend the execution of the possession order at the same court where it was made, but then request for the case to be transferred to your local county court for the hearing of any application to set aside the original PO

      There's no way I can get to the court in time today, it's an hour travelling and they close at 4pm. It will have to be tomorrow. On what grounds do you suggest I apply?

          For the purposes of clarification, I should be applying for the original PO to be set aside on the basis that the court was misled or that the eviction warrant be stayed? If the latter, on what grounds?

            Both

            You apply for the enforcement to be stayed for 14 days whilst you submit an application with any relevant evidence for the original PO to be set aside.

            If the court was misled by professional representatives, as well as drawing this to the attention of a Judge , preferably the Judge in Charge of the Court, you can report this to the Solicitors' Regulation Authority and/or the Bar Standards Board. This is very serious professional misconduct.

            If proceedings have been in the High Court, the High Court has an immediate jurisdiction over the conduct of solicitors.

                      Just for everyone's information I have also just made a complaint to the Financial Ombudsman about compulsory insurance related to the provision of the overdraft facility.

                          I'm not going to tempt fate by stating who it is. Call me paranoid but as a family we've 'gone through the wringer'. What with the 'alleged fraud then the bank taking our home. Once I've submitted form N244 and got a response then we'll see.

                                A thought. If the judge fails to allow a stay of execution tomorrow, can I ask for leave to appeal and would that delay the eviction warrant?
