  • Eviction date 23rd Feb Help required to delay

    Long story but not our fault that we're being evicted. Building society fine. business facility secured on our home. Friend conned us, took the business under, bank called in facility and the rest is history. I believe we've done everything we possibly can but now have an eviction date of the 23rd Feb. Young family would appreciate any suggestion to delay eviction.

    Can you clarify the situation a bit more so we can give you more advice ? Who is trying to evict you from your home, is it the mortgage lender ? Do they already have a possession order suspended on terms ?

      hi, building society mortgage is fine and been paid. Business bank have second charge on home. PG on ltd co a/c supported by 2nd charge on home. six figure sum. since business went under no money to put proposals so PO secured. eviction date 23rd

            Apologies if I appear short but suffering from bout of flu, busy packing and very stressed. trying to keep posts to absolute minimum and relevant.

            Thanks bernie. We hope to have somewhere to rent shortly but need to buy time, hence delaying the eviction date.

            Cornish pastie, what other information would you like that you feel may be necessary and relevant? Happy to provide it.

              Had a quick look at Shelter website but appears to be geared toward rented property. Since my situation is an ' all monies' case the rules are slightly different even to normal building society mortgage. Things like the Norgan principle, are totally irrelevant. I think we're past negotiating, short of winning the lottery.

                    Really soory to hear about this, can you tell me do you have somewhere to go?

                    There are several charities you could contact dependant on your circumstances.

                    Age, if you have children etc.

                      Because, if you do not explain more fully the situation you are in, it is impossible for you to be given the advice you have said you need urgently. Your initial post has not explained the legal position you are in.

                            Thanks Mrs James,

                            We're an honest, genuine middle class family. We try to help people we come across that need it. We're empathetic and sympathetic to people's situations. Helping the elderly next door neighbour or visiting someone in hospital etc. I'm the sort of person that if I see someone broken down on the side of the road I will stop to see if I can help. You get the picture of the sort of lives we lead and how we raise our children. The school and anyone who knows our children think they are wonderfull and so well behaved.

                            It really sticks in my throat that we're in this mess because of someone elses doing. i.e fraud!! The Police and Bank are not the slightest bit interested. The legal situation is 'You owe us the money. We have your house as security so get out!' Never mind the circumstances. Maybe I'm cynical and bitter right now but it seems that the large organisations and certain government departments view people's lives as having no value.


                            Financially, we're caught in the middle. We did have a successful business until the 'alleged' fraud undertaken by a former friend who joined the business. The money we had has all but gone. We still have aspirations and ambition and want our children to have some security in life and the opportunities that money brings. It's tough out there and it's pretty tough right here right now.

                            If we we're entirely dependant on state benefits and in social housing we would get all the help in the world. Such as legal aid to fight all the cr*p we're going through. The bank have made serious errors in our case like doubling up on personal guarantees, mis selling of insurance and yet because they have the financial resources to throw at people like us who don't have the money to fight back they just ride rough shod. Sadly it seems the more money you have the more justice you can buy. Unless as I said you have nothing.

                            Having said all of that, money cannot buy the love that as a family we share in volumes you could only imaginenor the respect and admiration that we receive from other people. We have no serious health problems and although happiness is elluding us at the moment if we come through this situation with all that intact then we will be stronger for it. We will regroup, take stock and begin to rebuild our lives. We will continue to help others as best we can.


                            I HOPE EVERYONE READS THIS

                            When you're in the depths of despair and fighting a losing battle against what is fair and just it is very easy to lose sight of the FACT that there are other people out there a million times worse off. I encourage anyone who reads this to take heart, remember that there are people worse off and to find the inner strength and support from others to get through whatever life throws at you.

                              Springer Spaniel. I thought I has summed the situation up in that we have an eviction order for next Thursday which I need to delay. Trust me when I say that I believe there is nothing more I can do except delay the eviction. PO secured. Not suspended, no surplus money or income to make realistic proposals. 'All monies' charge so six figure sum due on demand. If there is anything you need to know which you think might make a difference I'd be happy to tell you.
