    Hi all

    I've currently got arrears of 1800 , mth rent 650 and my landlord is threatening eviction

    we have no written tenancy agreement so i believe they can only go for rent arrears as grounds. is that correct?

    i have been paying full rent for at least 3 mths now to ensure situation doesnt get worse.

    will possession be granted irrespective if the arrears arent cleared?

    if i pay arrears down to below 2mths is that ok or do they have to be cleared?

    what procedure must he follow due to no written agreement?

    can he force me to sign a new agreement and if so can i insist on original verbal terms? he originally said house mine for as long as i wanted it for, amongst others

        Hi, bumping just means putting your post upfront as it has not been answered.
        Firstly have you spoken to your Landlord about the arrears ?
        Is there a reason why you have got behind with your payments such as job loss etc?
        I was just trying to see if there was anyway around this without it going to eviction, maybe a rent reduction for a while to help pay off your arrears.

        If this is not possible you still have rights even without a written contract and you landlord must follow the rules and serve a valid section 8 to evict you.

          My understanding is that as far as mandatory ground 8 is concerned the arrears have to be reduced to below the revelant amounts before any possession hearing.

            Thanks guys for clearing the bumping issue up

            We are having a meeting tomorrow - ive explained that at mo i can pay full rent but cant make guarantee on arrears.

            the problem started with our business going bust

            will let you all know outcome after meeting

              Merry xmas everyone and a happy new year

              just a quick update and a quick question

              i had meeting and have had to agree to 200 a week (50 off arrears)

              ive also now signed a tenancy agreement for 12 months

              in the agreement we've put 200 per week to include current arrears

              would this effectively wipe my slate clean so to speak in terms of 2 months arrears as, in effect, we have signed a new agreement at a higher rent, theoretically. or would the arrears still hold , in the eyes of the law?

              not planning on defaulting but need to know just in case they throw anything at me
