    hi how do i go about getting back charges from 2001 to 2008 was charged 50 pounds a month and ten pounds n dd calculate to £3,500 in charges these were added to loan , could no pay by dd because no bank account was taken off me.

    so i could only use a building society pass book to via cheque and could only draw funds when i had enough cash so had to wait till i got a balance in

    With difficulty I fear!

    2005/6 onwards should not be a problem, but anything over 6 years may be.

    It is worth sending an SAR asking for all information held and ensuring you include in the list a full statement of account since inception.

      agreed anything over 6 years is statuted barred under the limitations act 1980, so a claim for monies paid over 6 years back can not be brought to court or indeed enforced by a court.

        For mortage charges you can actually go back 12 years. It may be best to send a subject access request to get all your statements, then you can list them on a spreadsheet + interest. I would say that £50 per month is an excessive charge and it would not have cost them that amount of money to service your account.

          Lol didnt realise this was in the mortgage section just saw the OPs post where he said about a loan and also after seeing this thread too - credit file ccj - Legal Beagles Consumer Forum, i just thought he was on a bout a general loan not a mortage. :tinysmile_grin_t:

            I was assuming that it is a mortgage and not a loan. If it is a loan then it would be 6 years.

              In any case there may be an argument re Limitation Act s 32, money paid under mistake of law.

              However for payments undeer a Deed, eg mortgage, the Limitation Period is 12 years not 6 in England and Wales.
