  • Deposit Query -

    Right This morning I had a chat with our managment company for our rented flat.
    Now the deposit was £850, our flat mate moved out left arrears of £375, We left and the flat mate left a wardrobe and a sofa (his words where i don't care i don't want any depsoit back....Hmmm) anyhow.

    I will write a play for you, MC = Managment Company PD = Me..
    it went like this,

    1st Email a few days ago...
    MC - "if you clean the oven move the sofa we will return your Deposit"
    PD - "fair enough" And I did it minus moving Sofa"

    This Morning...
    MC - "I had to send our men to collect the wardrobe. In view of everything I can advise that the remainder of the deposit will not be returned. There is a strong smell of smoke in the property and the carpets will also have to be cleaned"

    PD -
    "I find this highly unfair, I made trips to the Skip with Other peoples Items. I am not a smoker therefore This cannot be from out apartment there was NEVER any smoking in this apartment and that I can assure you as a trustworthy person.
    I will not let that be the end of it, as stated CLEARLY in previous emails from yourself all that needed doing to refund the deposit was to remove the sofa from the outside. And that is in your words via email. .

    The other point I want to give out to you is that you handed Nathan back his deposit without a moments though. This is unjust as half of that also should have been mine.

    I would also appreciate it if you could send me the details of the deposit details that are held.

    I look forwards to your reply."

    MC = Then calls me personally to make an arrangment - and email proceeds
    "
    Was good to talk to you just and and I'm glad we managed to come to an amicable agreement.

    Following on from our conversation I can confirm the following deductions are to be made from the deposit of £850

    Rent arrears £375
    Removal cost 1 £75
    Removal cost 2 £50
    Share towards carpet cleaning £75
    Total deductions £575

    This leaves a balance of £275 to be returned to yourself. I have taken into consideration the difficulties you have experienced with your previous flatmate and have tried to keep the costs as fair as possible"

    My Questions to you are - Removal costs are different, should I fight this?? and is this fair and just. Should I now just accept and run or should I dispute BECAUSE she said over the phone do you agree to this amount? so basically asking do i think these charges are fair??

    Why is there two removal costs? That bit does look a bit strange, almost as though they removed one item then went back for the second one. Clarify the double removal costs perhaps. Furthermore, who else is paying for the cleaning of the carpet?
    Was the strong smell of smoke before or after the item was removed?(did the workmen smoke?

      Ooo good point, I know i have never smoked in the property, they have said, once they moved the air freshners it smelt of smoke.
      also the removal was and this i know once came for the sofa and then another time for the wardrobe, it's more a question of why are prices verying, I could mess it up as i guess they could charge twice at £75, The Carpet cleaning however is being shared with the managment company so I guess if i think about it, grab it and run would be my best option?

        Who's the idiot that looked around the place in the first place and missed the other item that needed removing then? Surely one removal cost is sufficient?

            Is there a deposit protection scheme in place ? These normally have a free arbitration service you can involve to resolve this.
