    I don't know. If he does, he does. You never know what rubbish they are going to come out with. But don't let that put you off bringing it up, the decision as to whether to repossess is down to the judge, who will listen to both sides and make a considered judgement. Use the weekend to get prepared, explain that if the refund is used to pay off the arrears you will still have enough to pay the next 5 months mortgage payment. You need to show that there is no need for a possession order. There is also the case which Tuttsi mentioned above whereby the arrears can be added onto the mortgage, you could use that to back up your case if needs be.

          How did it go today?

          There is only a certain amount of time given that you can go back and edit posts. I'm not sure how long it is but maybe you're out of time?
