  • Northern Rock lost documentation?

I am helping a friend make a claim against a mortgage adviser whose firm ceased trading in 2006. The mortgage is the Northern Rock Together mortgage and is not and has never been in arrears. Basically the adviser, who submitted the application for the mortgage, didn't comply with any of the MCOB rules. All my friend ever got from him was his business card! It was in 2005 so subject to the rules after M Day. My friend's claim is now with the FSCS. The have not yet defaulted the firm but they sent her an application form to complete. and have begun their enquiries.

I got her to send an SAR to Northern Rock and they sent the Offer of Loan, the unsecured loan agreement and statements, all of which she already has. I got her to write back and ask for a copy of the application form which contains her personal data and which she is entitled to have. I thought it strange they didn't send it with the other papers and I cannot think of any reason why they would not wish her to see it. The 40 days for reply is now up and no response. Do you think they have lost it or is there some reason they wouldn't wish her to see it?? The FSCS will certainly want to see it so if they don't have it they are in the doo-doo. I know she can go to the ICO but I just wondered what peoples' views of this are and if anyone else had ever had difficulty getting information from Northern Rock or if they had lost anyone's documents.
