  • Buyers of House Ignoring Requests for me to Collect my Property

    In late January I completed the sale of a property and there are now two issues relating to property of mine that was still in an outbuilding.

    Prior to selling the house the buyers were renting it from me and had requested one of the outbuildings be cleared to allow them to use it as part of the lease (this was all whilst waiting for some land registry issues to be resolved before they could complete the purchase). I left a small number of possessions in the other outbuilding including a washing machine (whilst not relevant it was almost new having only been used a couple of times). Once the house sale completed I made contact to request a time for me to send someone to collect these last number of possessions (enough to mostly fill the back of a standard van). They informed me this was fine but that admitted they had taken the washing machine for themselves a couple of months prior as theirs had broken down. They offered to buy it from me at this point and we agreed a price. I planned a collection with a delivery company but the new owners of the house then asked to delay by a couple of weeks as they were doing work that would make access to the outbuilding difficult. Since then I have contacted them a couple of times (always via WhatsApp) to rearrange and to get the money for the washing machine but they are now ignoring the messages.

    Can someone please advise the appropriate next steps in relation to both being given access to collect my property (which I'm sure they don't want hanging around) and getting the agreed value for the washing machine?

    You could threaten a claim for an order for delivery up of your possessions under s4 Torts (Interference with Goods) Act 1977.
