  • Giving Notice on Rental

    Good Afternoon

Hoping someone could advise on the below please?

I have been renting the same property since October 2005 and at that time was issued an assured tenancy agreement, however there are no start and end dates filled in in the main agreement body, only the first page and where we signed are dated on the day we were given the keys to the property.

I am now in a position to purchase my own property with the sale currently going through, so I have been looking over the original assured tenancy agreement to check on what notice period I need to give.

    I states the following:

'If, at the end of this time, you want to continue the tenancy and you have not already received from us two months' notice to end the tenancy, it will carry on from month to month as a monthly contractual tenancy. You must give two months' notice to end it. This notice must be given to expire on a rent payment day.'

So the advice I'm looking for is:

    - Do I need to give two months' notice if there no to & from dates entered? Or could I just give one month?
    - If either one or two months notice apply, it states the notice must be given to expire on a rent payment date - I've never heard of this before, and googling for answers, the norm seems to be that if the payment date is the 1st for example, the notice period would end the day prior to this?

Very confused with the various answers and advice given on various sites, so thought I would come here and try to obtain an expert opinion!

Thank you for reading and in advance for any advice!

Thank you for the advice - I have read the information on the Shelter website and other websites but the answers are very generic and not specific to my situation hence the reason asking on here.

If anyone else has any further input to my specific circumstances I’d really appreciate it.

      Thanks.

Steve - I did read the information before posting the link. Your situation was covered. Please read that page carefully, particularly the section on giving notice to end your tenancy.
