  • Remedies/Legal paths for breach of contract

    Could someone help me understand what legal paths one can take if there is a breach of contract found after property purchase/exchange? Cannot resolve the matter with the previous owner privately. Conveyancer won't help although agrees breach of contract has occured.

    Is it possible to file a small claims court claim against the previous owner? If this is a possible way then what to do when you don't know their new address?

      The first thing you must do is find the address. Without an address for your defendant, you cannot take legal action. If you cannot find the address by your own means, a tracing agent may be able to help for a fee of maybe £200-500.

      Once you have the address, a County court claim is a possibility.
