Buckle up this a bit long winded, so apologies!
I have an ex- GMAC mortgage & I have been doing some general admin/tidying up all the paperwork that I have for my personal finances. I found a letter that I was sent about 20yrs ago from the mortgage company that took over my mortgage from gmac. It basically said that there had been an oversight and asked me to sign the enclosed form. The form was for the Land Registry assigning the land/house To GMAC. I never signed it- mainly because I was a newly divorced, working full time mum to a chronically ill child- and it slipped my mind. Several years later I came across the letter and called the Land Registry who advised that it would be a problem for the mortgage company not me.
Anyway, crazy busy life working & being a single mum. Never really thought about it again. A few times over the years I was late making my payment & the mortgage company were very aggressive in pursuing it until I paid. Skip forward a few years to now;I decided to make a SAR- I received multiple calls from them asking why I wanted the SAR, very polite & pleasant. They supplied the info for the SAR & there was no copy of the Land Registry doc.
I also made a SAR to Land Registry & within the info is a copy of a letter from my conveyancing solicitor from date of ~2008 saying that the Land Registry assignation doc had not been signed & he had basically cancelled it. So when I got this info I decided to miss a few payments to see what the mortgage company’s reaction would be. Muted & friendly would best describe their response. I received a very pleasant friendly call from the mortgage company about my missed payment. I advised her that there were some missing documents in my SAR specifically the assignation docs & I believed that the mortgage may be dodgy & unenforceable, I advised her that once I discovered the potential ‘issue’ I did not make a payment in case it was taken as acceptance of the potential unlawful/ unenforceable nature of the mortgage - furthermore I would not be making anymore payments until it was resolved. I also mentioned it being an ex GMAC mortgage taken out just around the time the company crashed/whatever.
To say that she was really pleasant is an understatement.. I have since not paid another payment & just received a routine letter about missed payments(now 2).
I am undecided/ unsure of the next steps to take- if anyone has any advice/ guidance it would be really helpful.
