  • Urgent advice !

    I do hope someone can help/advise me please .
    We have sold our house and the point of completion / exchange .
    our buyers solicitor has raised an issue with the completion certificate . We sought permission in October 2916 but didn’t start until mid 2017 , we didn’t do anything during lockdown due to money and tradesman unable to get materials and we finally finished in 2020 however , we finally got the completion certificate in 2022 . The buyers solicitor is saying we should have got the completion certificate within 6 years and now we are at risk of losing our buyer .
    what can we do if anything to put our buyers mind at rest .
    Just to add , we did have a stage one survey done which didn’t raise any issues .

    Have you spoken to your solicitor? I wonder whether indemnity insurance might be available.

      Thank you for responding I appreciate your suggestion . I have spoken to my solicitor and she is flabbergasted as to why the buyers solicitor has done this at this late stage .
      Our buyers solicitor has now asked if we can provide evidence that the build was done according to regulations at every stage which we don’t have . I have said it was inspected at every stage therefore the completion certificate covers that .
      I just don’t know where to go from here .

        You have a problem that needs to be solved. In residential property transactions this is rarely achieved by arguing the law. Is your buyers' solicitor likely to back down?

        I raised the possibility of an indemnity insurance policy. Have you mentioned this to your solicitor?

          I am waiting to see if their solicitor mentions it . I am in daily contact with my solicitor . I just wonder if they are trying to get a reduction in price but we already reduced it for them because we needed a quick sale and they know this .
