  • Tomlin order house sale

    Hello
    thanks for allowing me to join. Pls may I ask if anyone can help advise - if a Tomlin order is in place signed by both parties regarding house sale. One party is awarded conduct of sale. If the other party wishes to now have conduct of sale and apply back to the court - will the court inform the other party or just grant this ?

    A hearing will be necessary, in which all parties will have the right to be heard.

        Update to this please could I ask - I have full conduct of sale and an agent - the other party solicitors refuses to answer any questions around sale or sharing of cost in a bid to appoint their own agent which they are continually pressuring me am
        i ok just to list as auction at suggested
        price of agent ?

          You really to stick to one thread.

          Disappointing that Shelter and CAB aren't helping at this time.

          There's quite a bit of advice here, I don't know it you would be entitled to Legal Aid, but it's a consideration.

              Please can anyone advise if I am able to request an urgent hearing/ directions in relation to request judge signing documents for sale ?. I already have an order and conduct of sale - other party are not complying . Help appreciated

                Act quickly, contact the National Debtline.

                Before you contact them do some preparation, have all the information handy -
                they ask for lots of relevant information.

                They might be able to prepare case and help at Hearing.

                  Yes, you can apply to the court to take steps to resolve the impasse.

                    Thanks atticus for helpful comments here. I have read both sections and emailed the court to ask what documentation i need to fill in and file.im
                    unsure if I need permission to bid . In regard to National debtline do you mean they may help with the hearing for request to sign documents ? Thanks again
