  • Help what do we do.

    Detached house.,2 flats 50% freehold.
    A house was built behind at end of drive. Long after purchase/occupation of top flat. Top flat rear garden originally turned into paved parking area. Before rear house build.

    Since house built at rear, original drive has shared access to rear build and access to original detached house fflat garden parking to rear.
    No parking on drive.

    Since the owner of the top flat died of cancer I have inherited the flat with 2 others.
    Three years on we have emptied and decorated both inside and out. It’s been on the market 3 months.

    The owner of the rear house. Has filled our flats garden/parking area with boats, windows and all manner of things He is having his house renovated and refuses to move all this stuff into his own garden. He also parks on the drive. Making it impossible for our potential purchasers/ viewers to access the drive or parking area. Which is large and full to the brim.
    we had told him he is trespassing and it’s illegal.

    We are 3 elderly women. We have contacted the council, police etc. no help. We now have to insure an empty flat which is double the norm and pay council tax plus utilities. He is trespassing and gets abusive. At our wits end. Need to sell to recoup or outlay and get rid of all this stress. .
    We gave him a months deadline in November end. Then again and today another He refuses and said his build could take months.
    Any advice please ?

    If you want to bring this situation to an end, you need to take action to make it happen. It appears that this will mean legal action - a court claim for an order requiring this neighbour to remove all items from your land and for damages for trespass.

    You should consult a solicitor. Do you have legal expenses cover with any insurance policy?

      Hi, thanks for your response.
      we were worried legal might be the only route!
      Yes I do have legal cover on my insurance. I had actually not thought of that.
      I will contact them.
