  • Remove Joint Leaseholder?

    Hi folks,

    I am an elderly lady and live alone. My property is leasehold (with over 90 years left on the lease) with no mortgage. The leaseholders of the property are my son and I. I inherited my late partner's share, hence I own 66.6% and him 33.3% respectively.

    My son is a mature adult and I put him on the lease when I bought the house over 15+ years ago, though he has never lived in the property.

    For clarity, I am the only party who paid in cash, in full for the property and the only party that has paid the land rent in full each year since.

    The relationship with my son has been very abusive in recent years. I no longer want him to be named on the property given 1) the abuse, 2) that he is financially reckless and could end up bankrupt and 3) that he owes me a sum of money that is in excess of his equity of the leasehold.

    I have written to him requesting he either pay me back the money or relinquish his equity as settlement. If he doesn't come back to me or refuses to relinquish the equity, what options do I have please to get him legally off my lease?

    This is not something you can easily do without your son's agreement.

    You may have the option of suing your son for what he owes you and, if you obtain judgement, enforcing that judgement by means of a charging order over his interest in the lease,
