  • Power of attorney for Spain

    Hi all,
I own a property in Spain jointly with my sons. We have recently put it up for sale and have potential buyers. When it comes to signing the property over would that require me to sign in front of the notary in Spain?
If so, I would have to sign on behalf of my sons who are unable to take time off to go there in person, so how would I obtain limited Power of Attorney for this matter?
I have asked a UK notary who says a Spanish lawyer should write the document and they can notarise it, but the Spanish lawyer says the UK lawyer should create it. I asked them to discuss with each other and write it between them but I have been waiting for around 2 months and they haven't got back to me
    Thanks for any advice

You need to knock their heads together. Your Spanish lawyer is not helping.

Either that or instruct the UK notary to prepare the document and get it signed and notarised, and hope the Spanish lawyer finds it acceptable.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf

Does the formal/official document need to be written in Spanish or English? Best to get that confirmed by Spanish solicitor before anyone drafts anything.
All opinions expressed are based on my personal experience. I am not a lawyer and do not hold any legal qualifications.
