    Hi all
    I have a friend who has asked me to put a 4-foot panel fence on his adjoining wall to another house, no one has lived in the house since 2019 when the old lady passed away.
    The daughter who inherited the house lives away and probably her family only stop there for a week maybe 2/3 times a year to tidy the garden and maintain the house, they did have the house up for sale 3 years ago where a few people showed interest and tried buying the property but the owners always pulled out before the sale went through.

    The son turned up about three weeks ago and started work on the garden, my friend had a polite word with him about a hedge that was creeping onto his garage door and would he please trim the hedge back which he did.
    My friend and I went to the builder's merchants last week and bought panels, posts and all the relevant materials needed, we plan on putting the fence up in the couple of weeks (weather permitting)
    The son came out to have a word with my friend about the fence and bluntly told him he can't put the fence up, my friend showed him the fence panels and walked him down the street to show him that they are the same height and design as all the other ones in the street and that the fence will be fixed to his side of the wall (bracketed on the top of the wall) and told him that he's spent £1k buying the materials and the fence is going up.
    The son tried to argue that they hadn't agreed to it so he couldn't put it up, my friend reminded him that he doesn't own the house his mother does (his mother has dementia and is currently in hospital having a hip replacement) so he gave the son an ultimatum either get the police or get a solicitor of forget about it and drop the attitude.

    The question is Does my friend have the right to put the fence up or could he facing a legal battle?
    They'e planning on selling the house as soon as the daughter passes away, it's only her that is holding on the the property because she grew up there and she won't give power of attorney to her husband and/or son.
