A property which was under sale as per the divorce settlement court order has been repossessed. Infact the property and the mortgage is only under one spouse's name and it seems this spouse has approached the Mortgage Lender to repossess the property (voluntary repossession). The Mortgage Lender was fully aware of the court order and is now not giving any information to the other spouse even though they have written authorization from the owner spouse. Can any action be taken against the Mortgage Lender by the non-owner spouse?
