  • Neighbour refusing right of access to my property - does he own the land?

    Hi,

    I have just bought a property with a large outbuilding at the back, which leads on to a lane. Since moving in, the neighbour from the farm behind has put a locked gate across the entrance to the lane and sent us a letter to say he owns the land and refuses access to it. In the letter he alludes to previous 'arrangements' with the person who lived here before us where they paid him for access so looks like he's trying to do the same again. I've checked his title register and the land is indeed listed on it, however it states that it is a lease with the term 2007 to 2022. There is no separate listing for the land on land registry. Am I correct in thinking that since the lease term has now expired he no longer has a claim to the land? Or could it be possible that he has extended the lease but it's not registered? Trying to find out as much information as I can before entering into any kind of discussion with him.

    There are all kinds of possibilities.

    What information did your seller give about this lane in replies to pre contract enquiries etc?
