  • transfer of title

not sure if this should be in the Wills section...anyway, my dad died last year leaving his house and shares to be split equally between my brother and me (we are joint executors). We have the Grant of Probate. My brother will have some shares, i will have the house, the remaining shares etc to be split. The house has a registered title in my dad's name and no mortgage. I now want to transfer ownership of the house into my name (my brother already has some shares), so i need, i think, to complete form TR1 and AP1, and ID1. No money is changing hands, so i assume it is a gift, but, then, it's not really. Obviously, i am the transferee but, as my dad has died, who is the transferor? And, does my brother need to be a party to this? I assume i will send also the Grant of Probate and dad's will, along with the aforementioned forms to the Land Registry. Any help gratefully received.

The transferor will be your late father's executors, i.e. you and your brother as executors.

No need to send the Land Registry the will, just the grant.
