  • Allotment holder refusing termination notice

    Hi, I've just joined an allotment comittee and there is an issue with one tenant. He has been sent a termination notice of 28 days as he has been sexually harassing a woman. He has written back that he refuses to accept the decision and he will not be leaving. What legal process should the allotment follow to evict him within the law?

    Has the person the committee wish to eject been convicted of harassment?
    Does the constitution of the 'allotment occupier's association' for want of a better term contain a clause, empowering it to eject a member from his/her allotment?
    Who is the landowner of the allotments?

      No doubt there has been a complaint from someone against the 'accused', has that complaint been investigated?
      Is there evidence? Witness Statements etc
      Could it be just a 'I don't like you thing'?
      Also what processes were followed?
      Is there an appeal process?
