  • Neighbour has drilled/nailed into wall on my property

    Apologies if this is in the incorrect place and for coming in strong. I have an extension where neighbour has been an t**** ever since its been built and abusive/violent etc. Wont allow us on their side and rubs our other neighbours up by claiming we are encroaching onto both sides but the other neighbours don't pay much attention to him as there is no encroachment.

    The t*** of a neighbour has asked us to make some fixes claiming it's damage to their wall but the thing there is no wall! As per land registry we are responsible for the fence/boundary that separates us. Any issues with building dirt/dust we have offered to clean multiple times but neighbour doesn't want us coming on their land.

    I was out in the garden and noticed there is stuff that have been attached either nailed or drilled into to the extension wall facing their side but the extension wall sits inside our property and does not form the boundary wall or fence, it is 20cm away from boundary.

    Included rough sketch above, the redline is the boundary, where as black is the extension separated by 20cm gap. Items are nailed/drilled onto black line besides the red.


    I have asked the neighbour if I can attach some of my stuff to his property and been told to **** off, so I know this isn't a mistake, I have asked for them to remove what they've attached to my wall but also been told where to go.

    At this present moment i don't want touch anything they attached in case they claim I've caused damage but i want them gone, they have been complete nightmare.

    I would be grateful for any advice of necessary steps i need to take?

    Your neighbour has committed trespass, which is an actionable tort, damaging your property in the process. You may sue for damages and an injunction to stop any repetition.

    But you have to live with this neighbour. Think carefully before you start a war.

      Thanks, We are way past having any kind of relationship, though in the past I've stopped myself escalating to legal (civil/criminal) action only due to hoping they'll eventually stop.

      If I do proceed would this be a claim via home insurance or a Solicitor?
