Neighbours scaffolding on my property for 1 year plus

      I doubt it is worth the stress of making a money claim as all that can be claimed is damages caused by the trespass and RedRuby has not mentioned she is seeking damages

      An application for an injunction to cease the trespass and have the scaffolding removed from the party wall as there was no party wall agreement.is probably all that is required.
      The application form N16A includes provision for costs


      Legal Expenses insurance attached to motor policies only covers legal costs arising from motoring matters

        Thank you Des8.

        Actually, some very distressing issues related to this situation have occurred since yesterday but which I have not mentioned as if I give details publicly, I fear my identity will be guessed easily if someone should look.

        I have been searching other places on the web for info but this really is the best site to receive advice.

            I have left my house for the day as I fear being in it if and when the letter is received by my neighbour as I have already been threatened.

            In trying to find the scaffolders who erected the scaffold myself, I have been given two voluntary opinions by two different scaffolding companies. They asked for me to send them photos, which I did and they have advised that professional scaffolding companies would not have erected it due to its material condition, that I have a strong case for having it taken down and that it was likely put up by a ‘bandit transit scaffolder’ and ‘for cash’ and that I will never find their phone number.

              Inform your insurance company that your concerned it will cause damage..
              crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even

                  If you are being threatened you must go to the police even if its only to keep something on the record NOONE should have to put up with threats from someone who is in the wrong

                      RedRuby Is this connected to the scaffolding problem or something completely different?

                      If something different best to start a new thread about it.

                      If it's related to the scaffolding problem please can you give us more information. How they are related issues isn't obvious to me.

                        Apologies.

                        Same set of neighbours but a different and ongoing problem which is being dealt with differently. I got confused as I have a lot going on. Sorry.

                        Please ignore that post.

                        I called my Building Insurers yesterday with regards to the scaffolding and found out I do not have policy cover for it.
                        They were exceptionally unhelpful and wouldn’t allow me to log my concerns regards to the situation or the situation itself.

                        Please advise.

                          Have you contacted your council's Environmental Health Department? Vermin infestation is a Statutory Nuisance which they are tasked to deal with. If this ends up being at your expense, then if you are not insured you will have to bear the expense.

                            I have contacted the council regards the rats yesterday and the day before.

                            I have lived at the same property for over 20 years and in that time seen several sets of neighbours come and go and never had problems with any vermin before.

                              Update 4

                              a) Scaffolding taken down this morning within time limit specified in letter

                              b) Scaffolders/builders/unknown trade trespassed onto our property and said disrespectful and derogatory remarks. It has all been caught on video. We made it known to them we were in the property but they decided not to ask for permission or let us know they needed to do so anyway.

                              c) Registration number of truck used to take scaffold away logged and photographed.

                              d) Signage on truck noted. A quick internet search reveals the name of company is most likely not the company or people who arrived today. Likelihood is the truck was sold from the company to someone else and as I had been told by scaffolding professionals: they are bandit transit scaffolders.
