  • Very abnormal situation, how to evict relative with no tenancy agreement?

    I inherited a property, full time care was set up for a disabled relative in the inherited property whose care had long been stalled. Social services had a care package set up through a care company, the relative's residence is considered supported living. I have no income, they moved in with the understanding that I would get rent. Social services had to sign a tenancy contract upon the relatives behalf as the relative has no mental capacity at all. fast forward over a year, they are not signing the contract, I am fighting but have run out of time and money. I need to evict my relative sadly lest I be forced to sell the property. How do I evict someone that has never paid rent, when there is no tenancy contract and when they have no mental capacity? Is it still a section 8 that I also send to social services?

    Not easy. Start with capacity. Who can take responsibility for the tenant's decisions?

      I am also the apointee of the individual, so I think me?

        You might be able to apply for such a power. That is not the same as having it. "Appointee" of what and how?

          I am responsible for his finances, its not lasting power of attorney though.
          A lawyer said I can just evict with a 1 month notice that I also send to the social worker. I dont remember them saying exactly what I have to write or what tenancy this defaults to, the name of the tenancy, there must be one though technically. I dont think its a section 8 I send, but dont want to phone up again just to pay for that info.
