  • Completing for JO - declaration of trust

    Currently they (my spouse and child) own the house as "Joint Tenants"
    My name is not on the property Title Deeds

    We have drawn up our own DIY declaration of trust that we all agree to, and will sign it in front of an independent witness.

    Correct me if I'm wrong
    but we just need to fill in form JO to put a restriction on the property Title Deeds (https://www.gov.uk/government/public...egistration-jo)
    Form JO:-
    panel 5 (4th option)
    X The Joint Owners are to hold the property (complete): “As detailed in the Declaration of Trust dated xx/feb/2023”

    and then send the complete JO to the Land Registry.

    I assume form JO will need to be signed just by the 2 owners currently named of the Title Deed,
    And not by me as well.

      When purchasing the property, we had to act fast in a frenzied housing market to get the house, and the lender would only allow 2 people on the mortgage and hence the title deeds. My income was the lowest.
