  • Received S8 and S21 Notices - complicated case

    I have received S8 and S21 Notices from my landlord's solicitors.

    This has left me feeling very unwell and shaken.

    I moved in here over 3 years ago and always paid the rent on time and tried to look after the place.

    Over the years, there were a number of disrepair issues which I reported by SMS to the landlord, with photos.

    Landlord did not fix or delayed.

    Roof leak, meaning rainwater was coming into bedrooms - reported August 2020 to Landlord and Council, futile patchup work done in October 2021 after the winter of 2020/1 (particularly cold and snowy)
    Black mould forming on bathroom ceilings, reappearing every few days despite cleaning with bleach and antifungals - reported December 2020 to Landlord, landlord promised repairs but did nothing
    Conservatory leaks every time it rains - reported April 2022, Landlord promised repairs, nothing done.

    Environmental Health from Council have been out but failed to understand all of the disrepair. They did a reasonable HHSRS Report identifying over 20 issues, only 2 have been rectified: the builder covered up the black ceiling mould with plastic sheeting and removed dodgy lights in the bathroom which were a hazard of electrocution.

    A TV was damaged by a roof leak over Christmas so I had to buy a new one just before Christmas day at a cost of £350.

    As a consequence, I could not pay January's rent. I currently owe one months rent.

    Instructed a No Win No Fee law firm to bring a disrepair claim against landlord in November. They are slow and are not doing their job properly. Have complained, but nothing seems to happen.

    Landlord's solicitors wrote back denying all disrepair and saying I had caused it all and I had tampered with the boiler.

    Landlord has not done the repairs, and the property has been allowed to deteriorate substantially with black mould showing up in the conservatory, dressing room, water leaks from the bath into the cellar where there are live electrics, a constant cold draught from rotten back door, lots of other things.

    Deposit was not protected within 30 days.

    I have been advised I can seek compensation from the landlord for not protecting the deposit within 30 days and that this compensation can be used to off-set the rent arrears. Adviser said the compensation is between 1 and 3 times the deposit.

    I'm frightened by what is happening. I have mental health problems and am in receipt of disability benefits and have an overnight carer.

    I don't want to continue living here but have no money to find somewhere else.

    The Council never came back to see if the repairs ordered, had been done. Now landlord is trying to blame me for the damage. Landlord is using Grounds 10 and Grounds 13.
