Developer sold communal area after my purchase was complete

Recently discovered that after living in our house for some time the developer sold ground in our development that was designated as a communal area. We were not notified of this and it wasn't until some of our neighbours children attempted to play on it. firstly, I want to ask if he can legally do this and secondly would this need changed on our deeds should we want to sell the house in years to come?

What, if anything, is said about this land in your contract with the developer? (Assuming that you bought your house from the developer and not 'second hand').
