  • Misrepresentation of property

    We found building work had been agreed by our vendor that she did not disclose. She allowed the neighbouring property to make upgrades and change aspects of the property that affected our property. The TA6 specifically asks if any aspect of the property has been changed and if any authority has written to you for agreement for work to go ahead. She ticked NO. We have found out the authority wrote to her and she agreed with the work.

    We've had the property 8 years so cant make a claim against the vendor. Our neighbour is arguing that we should of known about it and its nothing to do with him but he is claiming a right against this previous agreement. We had no knowledge, no way of finding out and we only found out about because he read it in his planning application. Also his vendor made the changes and had the agreement with our vendor not him directly.

    Can he flatly ignore the fact we had no knowledge even though we have a TA6 form to prove otherwise. It's not our fault and he is blaming us. Conveyancer could not have found this information our either.
