Hello,
I recently moved into accommodation that is classed as a HMO and I was provided with proof to show that the landlord has registered the house for HMO licence. However due to some noise issues that the landlord is not dealing with I decided to move out, before my 6 month tenancy agreement has ended. However, I still gave the landlord one month's notice and paid rent up until then.
My question is if my landlord would be able to take me to court? My rent agreement that the landlord and I signed has a section that says that the house I'm renting is not a HMO. Because of that if the landlord goes to court would I be able to get the claim dropped?
I have attached a copy of that section and a copy of my agreement redacted.
