  • Misled by an estate agent

    I recently made an offer on a flat, (which was accepted), on which the estate agent assured me that probate was well advanced.


    Today she told me that probate had not yet been applied for. This has put back completion by several weeks. Has a tort been committed?

    Several weeks might be optimistic.

      Has a tort been committed - unlikely. It depends on the facts, but what yu say so far falls short.

      As Atticus says, if the application for probate has not yet landed, then several weeks may be a second piece of over optimisim.

        It is worth pointing out that Estate Agents do have escalated duties to avoid misrepresentations, but that is as to (Property Misdescriptions Act ?) descriptions of the property itself, not necessarily as to process.
