    Afternoon everyone.
    My mother wanted to release some equity from her home and everything was running smoothly. Got to the solicitors stage to make sure house was OK and they found a charge that dates back 25yrs on the land registry. It was for some windows she had fitted that never got completed, my mum has no receipts or final invoice for this but I assume the charge was put on before they started the work.
    The company in question went bankrupt and the receivers took over and never took off charge or chased debt. They too went into liquidation and the company that took over know nothing about the debt or charge. The solicitors have sent numerous letters to different companies to try and trace who can remove charge off but have got nowhere. This has been going on for 3 months. They have now given up and told us we have to get a specialist to arrange this. Problem being, they were being paid via the equity release so we don't have the funds to be able to do this. I can get all evidence from the solicitors as to what they have done and I'm thinking of trying to sort this myself for her. Can anyone point me in the right direction as the Internet is a mine field as to what to do and my mum is 72 yrs old and doesn't understand what the solicitors are telling her.

    We do not know, but the charge probably came after she was sued fro nonpayment of an invoice. It seems most unusual for a charge to go on a property before that. Who is the charge in favour of?

      The assets of dissolved companies - including the benefit of charges - vest in the crown as 'bona vacantia' (orphan goods). You may need to deal with the Government Legal Department about this.
