My property in Worcester Park (Sutton) has an alleyway on the right-hand side, roughly 1.1m wide. Four properties have right of way. Neighbour on the left (alleyway runs in the middle) has been putting waste behind the gates (alleyway is gated) and started parking in front of the alleyway (taking about 50% of the space) since purchase of the second car, about 1 year ago.
When I bought the property, it already had paving which the neighbour put down matching his paving giving the impression he has ownership.
I informed the neighbour to respect the right of way and not to put waste (pallets) and park on the alleyway as the terms of the easement states it must be always kept clear. The exact wording is
‘Reserving to the owners or owner of 12 to 22 XXX Avenue a right of way in common with others at all times and for all purposes over the passage way at the back and south side leading into XXX Avenue.’
What is the best way to ensure the alleyway is always kept free and accessible? I am considering putting fences on either side of the alleyway which will limit any parking and redo the paving to something different to make the point that the is not his to do as he pleases.
