  • New build management fee

    Hi,

    I moved into a new build property in May 2020 when buying the house we was made aware there would be an annual service charge payable to the management company for maintenance of the site including; regular landscape maintenance and grass cutting of the common areas of the development. We are also freehold


    The last house on the development was completed in February/March 2021 and the builders have now moved off site. The development is not fully finished as the roads and pavements are yet to be finished and adopted by the local council.


    All property owners on the estate received an invoice on 2nd August 2021 requesting payment for the annual service charge by the 11th August the invoice was dated 12th July 2021 but the postmark on the envelope was dated 29th July 2021. Giving us just 9 days to pay. We do not feel this is fair.

    All property's are being charged different prices depending on their plot size however we was told it was be the same charge for all residents.

    Overall the development is still in an unfinished and unkept state with some of the issues below
    • Overgrown weeds taking over the landscape
    • Dead grass/turf and uneven grass/turf
    • Missing turf/grass in areas
    • No preparation work has been performed before planting areas on site resulting in weeds taking over
    • It has been observed that the gardeners have been throwing grass seed over rubble and have not weeded before laying turf or grass seed
    • Communal areas unkept and generally untidy
    • Missing turf/grass seed in areas as per the landscaping plan
    • Play area unkept, parents feel it is unsafe to allow their children to play there, the waste bin is always overflowing with dog waste bags.

    I have no experience in dealing with these company's and wondering what our rights are and what can we do?

    I have drafted a letter and plan to gather signature's from all the residents refusing to pay until the development is finished and well maintained

    Have you checked the paperwork regarding management fees? If you disagree with them, which you do, they need to be challenged.

      I assume you were made aware of the annual service charge in writing? Can you post a copy here?
